Our firm represented Mishan in an application for certification of a class-action lawsuit filed against it regarding fees collected by Mishan from its tenants due to the residence of personal caregivers in the tenant’s residence units. At the end of a complex mediation procedure, the parties reached a settlement whereby Mishan will reduce the rate charged for caregiver’s residence in the future only but will not retroactively refund any payments. The court approved the settlement, despite opposition from the Attorney General.
