Shai’s practice focuses mainly on international arbitration and complex commercial disputes, which have cross-border or multi-jurisdictional aspects, a field in which Gornitzky is regularly ranked Tier 1 by Legal 500 as “an excellent Israeli law firm with good international connections”, “a true market leader in international arbitration and mediation proceedings” and ‘experience going up against some of the world’s top-tier firms“.
Shai has extensive experience in representing Israeli and foreign companies and individuals in commercial disputes, including construction, insurance claims, shareholders disputes, D&O liability, technology and IP disputes, class actions, real estate disputes, professional negligence, product liability, and contractual disputes, before all of Israel’s judicial instances, including the Israeli Supreme Court, and in alternative dispute resolution proceedings.
Shai advised and represented clients in international arbitration, under the International Chamber of Commerce (ICC) Rules and advised on international arbitration matters under the International Centre for Settlement of Investment Disputes (ICSID) rules, the ICC, the London Court of International Arbitration (LCIA) rules, UNCITRAL Arbitration rules and the American Arbitration Association (AAA) rules.
Shai has also acted as a foreign legal counsel in disputes before foreign courts, including US Federal and State Courts, and handled drafting of expert opinions, discovery issues, and motion drafting in various cases. Shai advises clients on public and private international law matters, including international investment law, defense and homeland security, export control, and international trade.
Shai is a member of the Court of the LCIA, is a member of UNCITRAL experts group on high tech disputes, the commission on arbitration and ADR of ICC (Paris), the task force on emergency arbitrator of the ICC, and serves as an ambassador of the ICC Commission on the Belt & Road Initiative.
