Gornitzky represented China Railway Tunnel Group Co., Ltd. and China Railway Electrification Engineering Group Co., Ltd. in an administrative petition against their win of a tender (in the a scope of approximately 2 billion NIS), published by NTA – Metropolitan Mass Transit System Ltd., for the planning and performance of the various systems in the red line of the light rail train in the metropolis of Tel Aviv-Jaffa.
In a long and well-reasoned judgment, the Tel-Aviv District Court (the Honorable Judge Eliyahu Bachar) dismissed the arguments that there had been an invalid conflict of interests and that the winning bid does not comply with the threshold requirements of the tender. The Court accepted, among others, the arguments that the petition had been filed in delay and in bad faith.
The companies were represented by Advocates Ofer Tzur, Eli Cohen, Itzik Lazar and Omer Razin.
