Gornitzky represented the company, Elcon Recycling Center, in the Supreme Court, in an appeal against the decision of the District Court that had dismissed an originating motion.

Gornitzky represented the company, Elcon Recycling Center (of the Shikun & Binui Group), in the Supreme Court, in an appeal against the decision of the District Court that had dismissed an originating motion filed by a shareholder of the company, claiming, inter alia, the violation of a contractual right to prevent the dilution of his shares and to prevent his discrimination. The District Court, which dismissed the originating motion as a whole, accepted the company’s argument that the anti-dilution right was not intended to apply in circumstances in which the company was on the brink of insolvency. Upon the conclusion of the hearing held before the Supreme on the appeal that was filed by the Appellant, the Appellant accepted the Court’s recommendation to withdrew his appeal.
